Terms of Service

Clear responsibilities make AI and payments safer to launch.

These terms govern GivePay Commerce, LLC websites, payment referrals, AI products, consulting, custom development, and connected services. Effective July 21, 2026.

Agreement and eligibility

By accessing or using a GivePay website or service, you agree to these terms and any order form, checkout disclosure, or written service agreement that applies to your purchase. You must be able to form a binding agreement and must provide accurate business and account information.

GivePay services

GivePay offers payment-solution referrals and implementation assistance, AI templates and agents, voice and conversation workflows, consulting, custom development, integrations, and managed command-center services. Features and deliverables depend on the product and written scope selected. Setup, custom work, usage, and third-party subscriptions may be priced separately.

Third-party platforms and fees

Square, Clover, CardPointe, HighLevel, telecommunications carriers, AI model providers, and other connected services are independent third parties. Their approval, availability, pricing, hardware, processing, usage, registration, tax, contract, and account terms are separate from GivePay charges. GivePay does not control their service decisions or guarantee account approval.

HighLevel templates and account connection

The GivePay HighLevel template subscription and guided setup are separate from your HighLevel account, AI Employee, phone, messaging, carrier, registration, tax, and usage charges. You authorize only the scopes shown during installation and may uninstall the GivePay app through HighLevel. Saving an intake or connecting an account does not itself create or activate an agent, purchase a phone number, begin calling or messaging, enable auto-pilot, or submit regulatory registrations. Those actions require the applicable configuration, consent, testing, and approval steps.

Billing, renewal, and cancellation

The price, billing interval, included usage, setup fees, renewal, cancellation, and refund terms shown at checkout, in an order form, or in a written proposal control for that service. Usage beyond an included allowance and third-party charges may be billed separately by the applicable provider. Contact GivePay before purchase if an offer is unclear.

AI output and responsible oversight

AI systems can misunderstand instructions or produce incomplete or incorrect output. You are responsible for reviewing material decisions, customer communications, prices, legal or financial statements, regulated advice, and actions that affect people or money. GivePay does not promise that AI output will be error-free, uninterrupted, or suitable for professional advice.

Voice, messaging, and consent

You are responsible for lawful caller identification, recording and transcription notices, consent, calling and messaging permissions, opt-out handling, quiet hours, campaign registration, and the content used by your agents. You may not use GivePay services for unlawful robocalling, deceptive impersonation, spam, harassment, or evasion of carrier or platform rules.

Acceptable use and account security

Do not misuse the service, probe or disrupt systems, upload malicious content, infringe rights, expose credentials, collect payment-card security codes in AI conversations, or instruct an agent to perform unauthorized transactions. You are responsible for access to your accounts, connected tools, data, prompts, and approved automation rules.

Ownership

You retain rights in content and business material you provide. GivePay and its licensors retain rights in the GivePay service, software, templates, methods, branding, and pre-existing materials. Custom deliverable ownership and reuse rights are governed by the applicable proposal or service agreement.

Availability, disclaimers, and liability

Services are provided on an as-available basis to the extent permitted by law. GivePay disclaims implied warranties that cannot be reasonably supported by the selected service. GivePay is not responsible for third-party outages, provider decisions, lost profits, or indirect or consequential damages. Any additional limitations or remedies in a signed agreement control for that engagement; rights that cannot legally be limited remain unaffected.

Suspension, changes, and governing law

GivePay may suspend access to protect customers, systems, providers, or legal compliance. We may update these terms by posting a revised effective date. Unless a written agreement says otherwise, these terms are governed by Texas law, without overriding consumer protections that apply where you live.
